Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://padelguru.app website (the "Service") operated by PadelGuru ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

Age Restrictions

The Service is intended for users who are at least 16 years of age. All users who are minors (under 18 years of age) in their jurisdiction of residence must have the permission of, and be directly supervised by, their parent or guardian to use the Service. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to you using the Service.

User Profiles and Content

PadelGuru allows users to create profiles and share content related to padel. When creating a profile, you must provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device.

By creating a profile, you grant us the right to display your profile information to other users of the Service in accordance with your privacy settings and these Terms. You control who can view certain information through your privacy settings.

You understand and agree that we may access, preserve and disclose your account information if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary to comply with legal process or to protect the rights, property, or safety of PadelGuru, its users, or the public.

Communications

By creating an Account on our service, you agree to receive communications from us related to your account and the Service. You may also opt-in to receive newsletters, marketing or promotional materials, and other information. You may opt out of receiving any non-essential communications by following the unsubscribe link or instructions provided in any email we send.

Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or PadelGuru cancels it. You may cancel your Subscription renewal by contacting PadelGuru customer support team or by canceling the Subscription from your account dashboard.

For EU customers: according to EU consumer protection law, you have the right to cancel your subscription within 14 days without giving any reason. The cancellation period will expire after 14 days from the day of the conclusion of the contract.

User Content

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content") related to padel. You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you represent and warrant that: (1) the Content is yours (you own it) or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (2) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

You retain any and all of your rights to any Content you submit, post or display on or through the Service, and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through the Service.

PadelGuru reserves the right to remove any Content that violates these Terms or that we deem objectionable, inappropriate, illegal, or harmful to the community.

Coaches and Content Creators

If you are a padel coach or content creator using the Service, you maintain ownership of your original content but grant PadelGuru a license to display, distribute, and promote your content through the Service. You are responsible for ensuring that you have all necessary rights to the content you upload and that it does not infringe on third-party rights.

For monetization features, payments will be processed according to the terms specific to each creator program, which may be provided separately.

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of PadelGuru and its licensors. The Service is protected by copyright, trademark, and other laws of both the European Union and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PadelGuru.

Data Protection and GDPR Compliance

For users in the European Union, we comply with the General Data Protection Regulation (GDPR). You have the right to access, rectify, port, and erase your data. You also have the right to object to and restrict certain processing of your data. This includes the right to object to our processing of your data for direct marketing and the right to withdraw consent at any time when we process your personal data based on your consent.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or request account deletion through your settings. EU users have the right to delete their account and personal data under GDPR regulations.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Limitation Of Liability

To the maximum extent permitted by applicable law, in no event shall PadelGuru, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the European Union and your country of residence, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
